Imatech Properties LTD is referred to in these Terms as “Imatech Properties”, “we”, “us” or “our”.

If you do not agree with these Terms, you should not use the Website.
2. Purpose and Scope of the Website
The Website is primarily an informational website providing information regarding Imatech Properties, property opportunities, property management, real-estate investment opportunities and related services in Cyprus.
Unless expressly stated otherwise:

Standard terms imposed on EU consumers are subject to unfair-terms controls and must not create a significant imbalance contrary to the requirement of good faith.

No exclusion or limitation in these Terms applies where it would constitute an unfair consumer contract term or otherwise contravene mandatory consumer law. EU law restricts the enforceability of pre-formulated terms that create a significant imbalance to the detriment of consumers.
17. No Guarantee of Property Availability or Investment Outcome
Unless expressly guaranteed in a separately executed written agreement, we do not guarantee:
- continued availability of a listed property;
- successful completion of a proposed transaction;
- planning or development outcomes;
- financing availability;
- rental occupancy;
- rental income;
- capital appreciation;
- investment return;
- tax treatment; or
- future market conditions.
Any investment-related projections, market commentary or potential-return information should be evaluated with appropriate independent professional advice and due diligence.
Nothing in this clause limits liability for fraudulent or misleading statements or any other liability that cannot lawfully be excluded.
18. Suspension or Termination of Website Access

23. Governing Law
Subject to mandatory rules applicable to consumers, these Terms and any non-contractual obligations arising out of or relating to them are governed by the laws of the Republic of Cyprus.
Where you are a consumer and mandatory conflict-of-laws rules entitle you to protections under the law of another country that cannot contractually be excluded, this governing-law clause does not deprive you of those protections.
Article 6 of the Rome I Regulation limits the extent to which a contractual choice of law can deprive an EU consumer of mandatory protections that would otherwise apply.
24. Jurisdiction
Subject to mandatory consumer-jurisdiction rules and any exclusive jurisdiction created by applicable law, the courts of the Republic of Cyprus shall have jurisdiction in relation to disputes arising from or connected with these Terms or use of the Website.
If you are a consumer, this clause does not prevent you from relying on any mandatory jurisdictional rights available under applicable EU law.
In qualifying consumer-contract cases, Regulation (EU) No 1215/2012 permits consumers to bring proceedings in specified circumstances in the courts of their own Member State and restricts contractual derogation from those protections.
